PASC-SEIU Health Benefits Plan

PASC and the United Long Term Care Workers' Union (SEIU Local 6434) have successfully negotiated for a Health Benefits Plan for IHSS providers who work 80 or more hours per month for at least two consecutive months. The PASC-SEIU Homecare Workers Health Plan is provided by the LA County Community Health Plan and is administered by PASC.

Common Paycheck Deductions

The following are common deductions that can be withheld from an IHSS provider's paycheck. Included are:

1. State Disability Insurance (SDI)
2. Federal Income Tax (FIT)
3. State Income Tax (SIT)
4. Social Security (FICA)

There may also be deductions for Medicare, vision care, dues/agency fees or special withholdings (i.e., lien, child support, etc.). Deductions should not be mistaken for Share of Cost (SOC). Share of Cost is the amount that the consumer pays to the provider out of the consumer’s own pocket.

IHSS Providers as Mandated Reporters

When working in In-Home Supportive Services (IHSS), as well as a variety of other health-related fields, workers take on an often-unknown responsibility under state law, which is referred to as the role of a mandated reporter. The mandated reporter role is assumed by any person who takes on full-time or part-time responsibility for the care of an elder or dependent adult. The responsibilities of the mandated reporter are defined by the State of California Welfare and Institutions Code, which declares that the mandated reporter must make a report to the proper authorities when he/she observes or has knowledge of an incident involving abuse, is told by the victim of an incident of abuse, or suspects any incidence of abuse. Incidents of abuse may include, but are not limited to, abandonment, abduction, financial abuse, isolation, mental abuse, physical abuse, neglect and self-neglect.

An IHSS homecare provider in Los Angeles County who witnesses any of the above must, by law, file a report with Adult Protective Services (APS). Reports can be made in writing or by telephone. When making a report to APS, it is important to include as much information as possible. Reports should include, but not be limited to, the following:

1. Reporter’s name, address, telephone number and occupation
2. Victim’s name, age and address
3. Names and addresses of any other individual responsible for the victim’s care
4. Nature and extent of the victim’s condition
5. Date and place suspected incident occurred
6. Information on suspected perpetrator
7. Any other helpful information

When making a report, all information given, including the reporter’s identity, is voluntary and confidential. Reports can be filed anonymously, but it is important to remember that the more information that is provided to the APS worker, the better prepared the agency will be to investigate the case.

Once a report is filed, an APS social worker will visit the victim within two to four hours if the report is such that the victim is in imminent danger, or within 10 days (depending on the gravity of the situation) to investigate the reported incident. If it is determined that the victim is in danger, the social worker will work with the individual and/or family members and other interested parties to eliminate any danger to the person.

A mandated reporter’s failure to report any suspected abuse is punishable by law as a misdemeanor with a penalty of up to six months in prison, a $1,000 fine, or both. Failure to report any abuse which leads to a victim’s death or great bodily injury carries a penalty of up to one year in prison, a $5,000 fine, or both.
