AB 40 (Yamada) - Elder Abuse Reporting This bill would require mandated reporters to report instances of elder abuse to both the local ombudsman and local law enforcement agencies. Status: This bill was passed by the Assembly on May 23rd. However it was not passed out of committee in the Senate before the August 26th deadline for bills to be presented to the Senate floor. No further action can be taken on AB 40 during the current legislative year.
AB 138 (Beall) - Elder Economic Planning Act of 2011 This bill would require the California Department of Aging to report data from the Elder Economic Security Standard Index (Elder Index) for each service area included in the department’s state plan on aging. The act also establishes area agencies on aging with specified duties, and develops and implements a plan for the delivery of services based on need. This bill would also require the plan to utilize the Elder Index as a reference when making decisions about allocating resources to meet basic needs for elders in each planning and service area. Status: This bill was passed by the Assembly and Senate, and was signed into law by Governor Brown on June 9th.
AB 622 (Dickinson) – Civil Grand Juries This bill would require a civil grand jury to meet with the chief executive or department head of an agency subject to its investigation at least 21 days prior to the issuance of its final report to discuss the nature of the investigation and to receive the comments of the chief executive or department head. In addition, this bill would authorize any witness before a civil grand jury who is or becomes the subject of a grand jury investigation to have counsel present on his or her behalf while he or she is testifying. Status: This bill was passed by the Assembly and Senate, and was signed into law by Governor Brown on June 9th.
AB 876 (Valadao) – Hiring IHSS Providers Existing law allows an IHSS consumer, or their authorized representative, to hire a provider who has been convicted of certain disqualifying crimes by submitting to the county a signed individual waiver form. This bill would prohibit a provider applicant from signing his or her own individual waiver form as the recipient's authorized representative. This new regulation would not apply when the provider is a parent, guardian, or person having legal custody of a minor recipient, a conservator of an adult recipient, or a spouse or registered domestic partner of a recipient. Status: This bill was passed by the Assembly on May 19th and passed by the Senate on June 24th. It was signed into law by Governor Brown on July 7th.
AB 889 (Ammiano) – Domestic Work Employees This bill would regulate the wages, hours, and working conditions of domestic work employees, which includes housekeepers, nannies, and caregivers for children, persons with disabilities, and the elderly. This bill would also provide a private right of action for a domestic work employee when those regulations are violated by his or her employer; provide an overtime compensation rate for domestic work employees; and would require annual pay increases for domestic work employees. Status: This bill was passed by the Assembly on June 2nd, and by the Senate Labor and Industrial Relations Committee on July 7th. However it was not passed out of the Senate Appropriations Committee before the August 26th deadline for bills to be presented to the Senate floor. No further action can be taken on AB 889 during the current legislative year.
SB 393 (Hernandez) – Patient-Centered Medical Home Act of 2011 This bill would establish the Patient-Centered Medical Home Act of 2011.
SB 411 (Price) – Home Care Services Act of 2011 Under existing law, a private provider of in-home care services is not subject to the requirements of a provider who works within the IHSS program. The bill would, among other things, prohibit a home care organization from hiring an individual as a home care aide unless that individual meets certain requirements, including, but not limited to, demonstrating that he or she has specified language skills, has completed required training, and cleared a criminal background investigation coordinated by the home care organization.
SB 930 (Evans) – IHSS Enrollment and Fingerprinting Requirements This bill would delete the requirements pertaining to the fingerprinting of IHSS recipients, and the requirement that the provider timesheet include spaces for provider and recipient fingerprints. This bill would also delete the requirements and prohibitions related to the use of a post office box address by an IHSS provider. In addition, this bill would require public authorities to send the State Department of Social Services a copy of the criminal offender record information (CORI) response obtained through the Department of Justice, when an individual who has been found in-eligible to provide IHSS has appealed the public authorities decision.
